Agreement for building works

Surrey extension

This agreement is made on the date it is signed.

Parties

(1) of (“the Contractor”).

(2) of (“the Homeowner”).

Background

A. The Homeowner wishes to have a rear extension built at the property.

B. The Contractor has agreed to carry out that work on these terms and the project proposal.

Agreed terms

1. Documents and standard of work

1.1 The Contractor shall carry out and complete the works in a proper and workmanlike manner, with suitable materials, and in line with this contract, the project proposal and the attached drawings.

1.2 Those documents are to be read together. If they differ, the later document that both parties have agreed prevails.

1.3 The Contractor shall meet the Building Regulations and any planning permission that applies, and shall leave the working area tidy at the end of each day.

2. Price and payment

2.1 The contract sum is £48,000.00, being the total of the stage amounts in the project proposal.

2.2 The Homeowner pays each stage through Fort. The amount of a stage is the amount stated for it in the proposal.

2.3 Funds for a stage are secured before work on that stage starts, and are released when the agreed stage is complete.

2.4 A stage may include substages. A single payment cannot be more than £10,000, and a stage or substage cannot last longer than 45 days from the date its funds are secured.

3. Time, access and changes

3.1 The Contractor shall not start a stage until its funds are secured. The Homeowner shall give access at reasonable times.

3.2 No change to the works, the price or the time is to be carried out unless the Homeowner has agreed it. An agreed change is recorded on the project and forms part of this contract.

4. Completion and defects

4.1 A stage is complete when the work described for it in the proposal has been done. The Homeowner shall not withhold agreement for minor items that do not affect use.

4.2 The Contractor shall put right defects in a completed stage that the Homeowner reports within six months of that stage being released, and that are due to workmanship or materials.

5. Law

5.1 This contract is governed by the law of England and Wales. The parties shall try to settle a disagreement from the project record before either starts proceedings.

The Fortified Standard

Trust shouldn't be left to chance.

Every Fortified Contractor goes through a 15-point process designed to help Fort assess the people and businesses on the platform.

What does Fortified mean?

Fortified Contractor status means these 15 checks have been completed. Thirteen are carried out by Fort. Stripe verifies identity and checks for fraud, and continues to monitor payments and account risks. The status gives Homeowners more information about the people and businesses they are considering.

We run ongoing checks to ensure that Contractors on Fort are held to high standards after signup.

You can still use Fort.

Disputes & accountability

When something goes wrong, the project already has a record.

Disagreements can happen. Fort keeps the agreement, project stages, conversations, photos and changes together, giving both sides a shared record to refer back to.

A clear process

From raising a concern to considering independent assessment where appropriate.

  1. 01

    Raise the concern

Set out the issue through the project's shared conversation and explain what needs addressing.

  2. 02

    Review the record

Refer to the accepted proposal, agreed stages, messages, photos, documents and recorded variations.

  3. 03

    Work towards a resolution

Use the shared information to clarify expectations and explore the next steps.

  4. 04

    Where appropriate

    Independent assessment, where appropriate

Fort can arrange for an independent RICS-chartered surveyor to assess the work and provide an assessment to support the dispute process. The party at fault is liable for the surveying cost.

One shared project record

Keep the information that matters together, from the original agreement to the completed work.

The appropriate process and outcome depend on the circumstances, the evidence available and the applicable agreements.

Better projects start with both sides on the same page.

Fort brings Homeowners and Contractors together to agree the work, keep projects organised and manage payments with greater clarity, from the first conversation to the final stage.
